Guidelines for foreign college graduates to work in China

Foreign graduates who have obtained a master's degree or above in a well-known university abroad and have graduated within one year, or foreign students who have obtained a master's degree or above in a university in China and have graduated within one year, apply for a foreigner's work permit in China in accordance with these guidelines.

Approval criteria

Foreign college graduates should meet the following conditions for employment in China:

1. At least 18 years old, in good health;

2. No criminal record;

3. Excellent academic performance, with an average score of no less than 80 points (hundred point system, other points are converted into hundred point system) or above b+/b (grade system), and no record of bad behavior during school;

4. Obtain corresponding academic qualifications and degrees;

5. There is a definite employer, who is engaged in the work position corresponding to the major he has learned. In principle, the salary shall not be lower than the average salary of on-the-job employees of local urban units, and the specific standard shall be reasonably determined by the provincial human resources and social security departments according to the actual situation of the employment market and the needs of introducing talents;

6. Hold a valid passport or other international travel documents that can replace passports.

Matters needing attention

1. When the employment of foreign college graduates expires, if the employer intends to continue the employment, it can continue the employment after fulfilling the examination and approval procedures as required. If the personal income tax paid by foreign college graduates is lower than the tax payable for their intended salary, or the salary offered by the employer is lower than the specified standard, the work permit shall not be extended.

2. The State implements quota management on the work of foreign college graduates in China. The quota varies from city to city, and the acceptance will be suspended when the quota is full.

Handling procedures

Foreign graduates who have obtained a master's degree or above from a well-known overseas university and have graduated within one year should follow the following two steps:

1. Apply for the foreigner work permit notice before entering the country, and the handling procedures are as follows:

(1) Apply online. The employer applies in the "management service system for foreigners to work in China" (select the "Notice of applying for foreigners' work permit (before entry)" module in the directory tree on the left of the home page, and select the "C other foreign personnel" module on the right).

(2) Online pre examination and acceptance. The accepting institution shall conduct online pre examination and accept the application of the employer within 5 working days from the date of material submission (the date of material submission is not counted in the period).

(3) Review. The decision-making body shall review and make a decision within 10 working days from the date of acceptance.

(4) Decision. If the decision is passed, the decision to grant the administrative license shall be made, and the notice of foreigners' work permit shall be generated online. The system will automatically generate the foreigner's work permit notice and exchange the information to the foreign affairs department (embassy or consulate abroad) through the online system. The employer can print the foreigner's work permit notice on the system client and send it to the applicant. Tip: the applicant should apply for Z visa entry at the embassies and consulates abroad with the printed foreigner work permit notice and other materials required.

2. Apply for foreigner work permit within 15 days after entry

(1) Apply online. The employer applies in the "management service system for foreigners to work in China" (select the "apply for foreigner work permit (after entry)" module in the directory tree on the left side of the home page).

(2) Online pre-trial. The accepting institution shall conduct online pre examination on the application of the employer within 5 working days from the date of submission of materials (the date of submission of materials shall not be counted as the period).

(3) Acceptance. After the online preliminary review is passed, the employer must submit paper materials to the acceptance institution (according to the requirements of the required materials, verify the originals of all attachment materials uploaded during the online application for license notice and license, and receive the corresponding originals or copies). If the paper materials are complete, meet the requirements, and consistent with the materials submitted online, the acceptance institution will accept them on the spot and issue the "foreigner work permit acceptance form for foreigners to China".

(4) Review. The decision-making body shall review and make a decision within 10 working days from the date of acceptance.

(5) Decision. If the decision is passed, the decision to grant the administrative license shall be made, and the foreigner work permit shall be prepared and issued within 10 days from the date of making the license decision (the system displays "the certificate information has been checked" and can be obtained at the acceptance institution). Tip: the applicant can obtain the foreigner work permit at the acceptance institution with the foreigner work permit acceptance form and the ID card of the handler (if the handler is not registered in the system, it is necessary to issue the power of attorney of the employer). After obtaining the permit, the applicant can apply for a residence permit at the public security entry-exit department.

Foreign students (with valid residence permit) who have obtained a master's degree or above in a university in China and have graduated within one year must follow the following procedures:

1. Online application. The employer applies in the "management service system for foreigners' work in China" (select the module of "domestic application for foreigners' work permit in China" in the directory tree on the left of the home page, and select the module of "qualified by other approval authorities" on the right).

2. Online pre-trial. The accepting institution shall pre-examine the application of the employer within 5 working days.

3. Acceptance. If the application passes the preliminary examination, the employer shall submit paper materials to the acceptance institution (check the originals of all uploaded attachment materials of this application and receive the corresponding originals or copies according to the requirements of the required materials). If the paper materials are complete, meet the requirements, and consistent with the materials submitted online, the acceptance institution will accept them on the spot and issue the "foreigner work permit acceptance form for foreigners to China".

4. Review. The decision-making body shall review and make a decision within 20 working days from the date of acceptance.

5. Decision. If the decision is passed, the decision to grant the administrative license shall be made, and the foreigner work permit shall be prepared and issued within 10 days from the date of making the license decision (the system displays "the certificate information has been checked" and can be obtained at the acceptance institution). Tip: the applicant can obtain the foreigner work permit at the acceptance institution with the foreigner work permit acceptance form and the ID card of the handler (if the handler is not registered in the system, it is necessary to issue the power of attorney of the employer). After obtaining the permit, the applicant can apply for a residence permit at the public security entry-exit department.
