How do foreigners transfer employment in China

For us Chinese, job hopping, leaving and changing jobs are all common things. For foreigners working in China, if they do not go through the transfer procedures according to the law, it may lead to very serious consequences. For the work of foreigners, the process of applying for employment transfer of foreigners must be handled simultaneously. If the work unit is changed but the work permit is not changed, it will not meet the requirements for foreigners to work in China and will be regarded as illegal employment. If the work position of the company has not been changed and the work type residence permit is still within the validity period, the foreigner can apply for the transfer of work permit without re applying.

Cancel existing work permit

1. Required materials:

(1) Application form for cancellation of foreigner's work permit in China

(it shall be printed out after filling, and shall be signed by the applicant and stamped with the official seal of the company)

(2) Termination of employment relationship, termination of contract or other supporting materials related to cancellation reasons

2. Submit online application for cancellation of foreigner's work permit

After entering the system, click "foreigners' work permit cancellation in China" on the left to start filling and uploading the attachment materials:

(1) Application form for cancellation of foreigner's work permit in China

(2) Termination of employment relationship, termination of contract or other supporting materials related to cancellation reasons

(3) Cancel the work permit after passing the review

 

Submit new work permit application online

1. Online application process

After entering the system, click "domestic application for foreigners' work permit in China" on the left to start filling and uploading the attachment materials

(1) Application form for foreigners' work permit in China

(2) Employment contract or employment certificate

(3) Applicant's passport or international travel document

(4) Visa or valid residence permit

(5) Work permit for foreigners

(6) Certificate of cancellation of original work permit

After completing the filling, submit the application, and generally the results will be released within 5 working days.

2. Precautions

(1) Apply at least 30 days before the expiration of the original residence permit

(2) Those who change to a new post (occupation) must apply for a foreigner's work permit in China again.

(3) For those who are transferred as foreign high-end talents (Class A), relevant supporting materials shall be submitted.

(4) All original paper materials and Chinese translations must be uploaded to the processing system electronically.

(5) Education, no crime certificate, physical examination, etc. do not need to be prepared and submitted again

(6) If the new company has not recruited foreigners, it needs to go through the system registration of the Foreign Affairs Bureau and the filing of foreign-related enterprises

 

Application for residence permit

After receiving the alien work permit, you need to apply for a new work type residence permit

Application materials:

1. Visa application form for foreigners

2. Accommodation registration form

3. Passport

4. Work permit for foreigners

5. Alien Residence Permit Application Report

Note: if accompanied by family members, each family member shall provide supporting materials and corresponding proof of kinship.

It generally takes 10 working days (15 working days in the peak period) after the entry-exit administration accepts the materials.
